Special Tribal Criminal Jurisdiction Sample Code
The Special Tribal Criminal Jurisdiction (STCJ) Sample Code is one example of what a stand-alone VAWA 2022 implementation code could look like. The hypothetical code meets federal requirements and includes all necessary components for implementation of STCJ. The sample code is NOT the only way, or even the best way, to draft a VAWA 2022 compliant code. Please note that this code contains policy choices that may not align with your community’s values or legal framework—and that are not required by federal law. These decisions should be carefully reviewed and discussed. To support this process, annotations highlighting key areas are included. The forthcoming STCJ Tribal Code Drafting Resource has been cross-referenced for deeper analysis and guidance.

This quick reference checklist has been developed to assist Tribes who successfully implemented VAWA 2013’s Special Domestic Violence Criminal Jurisdiction (SDVCJ) provisions and now want to update their codes to implement VAWA 2022, Special Tribal Criminal Jurisdiction (STCJ). The checklist can be used as you review your existing Tribal code to identify areas that need to be updated or repealed. This quick reference checklist is intended as a starting place and does not incorporate specific considerations that may be relevant to each Tribal community.
